Guardianships

Representation in Ohio Guardianship Proceedings

A guardian is appointed by the Probate Court when a person is no longer able to care for or protect themselves. The court appointed guardian then oversees the legal and financial affairs of the individual. Elderly relatives, a person with a severe physical or mental disability or a minor may be in need of the protection a guardian provides. If you are concerned about a loved one's ability to manage their personal or financial affairs on their own, contact Attorney Thomas Taneff to review your options. As a Former Probate Court Magistrate Mr. Taneff regularly heard guardianship matters and can now guide you through your alternatives.

There Are Different Types of Guardianships-Which Meets The Needs of Your Unique Situation?

Ohio law allows for a number of different types of guardianships.

A Guardian of the Person is appointed to protect and have physical custody of a ward and provide for their daily needs, paid from the ward's assets.

A Guardian of the Estate is appointed to manage the property and financial assets of the ward for the ward's best interests.

A Limited Guardian is a guardian whose powers are specifically limited by the probate court.

An Interim Guardian is appointed after a former guardian is temporarily or permanently removed or has resigned.

An Emergency Guardian is appointed by the Probate Court without a formal hearing and is necessary to prevent immediate injury to the person or estate of the ward.

A Conservator is a person appointed by the Probate Court at the request of a mentally competent adult who is physically unable to manage certain aspects of his or her life.

Each type of guardian has certain obligations or liability. It can be both emotional and confusing. In addition, the guardianship process is complex. An attorney must have both the experience and knowledge of the courts to protect both the rights of the individual the guardianship is being sought for and the individuals seeking to become the guardian.
